The Principal Sessions Judge Jammu has directed the Court below to expedite and conclude the trial at the earliest in the Sub-Inspector (SI) paper leak scam and observed that the Central Bureau of Investigation (CBI) may seek cancellation of bail granted to accused if they are found to flout the conditions laid in the bail.
The court was hearing the pleas filed by the CBI questioning the bail orders granted to five accused persons-Yatin Yadav, Pradeep Kumar, Sunil Kumar, Bajinder Singh and Rakesh Kumar. The court while closing these pleas said that there is no allegation against the accused persons having violated the terms and conditions as laid down by the court below while granting them bail.
The court further added that the record reveals further that the accused have also not influenced the trial either trying to win over the witnesses or threatening them from deposing against them as such there is no reason to cancel the bail at this stage.
“These Observations shall not come in the way of investigating agency to seeking cancellation of bail at any time if the conditions imposed by the trial court are not adhered to or floated by any of the accused” Sessions Judge said, adding “the trial court shall expedite the trial and make efforts to conclude the same at the earliest”.
The court has also made it clear that in case respondent/Enforcement Directorate collects any material during the period that the accused are on bail that they are influencing the witnesses or have tried to intimidate them the prosecution would be within their rights to move an application before this Court for cancellation of their bail.
The case of CBI is that the accused persons have played a key role in the criminal conspiracy to leak the question paper and have collected huge amounts of cash in lieu of sale of leaked JKPSI written exam question paper. (Daily Excelsior)
