Court issues notice on petition challenging reservation policy, Hearing set for Dec 27

Srinagar, Dec 11: The High Court of Jammu & Kashmir and Ladakh has issued a notice in response to a petition filed by Dawar Ali, supported by the Jammu & Kashmir Civil Society, challenging the government’s current reservation policy. The petition has been filed through Team JUS Advocates & Solicitors Front, New Delhi, led by Advocate Junaid Mohammad Junaid.

The petition describes the existing reservation policy as “unreasonable and illogical” and seeks its annulment. It calls for the establishment of an independent committee to reevaluate and rationalize the policy, ensuring it aligns with principles of equity and transparency.

A bench comprising Justice Rajnesh Oswal and Justice Muhammad Yousuf Wani directed the respondents to file their replies within three weeks while instructing the petitioners to complete the necessary steps for service within a week. The petition has been clubbed with WP(C) 2762/2024, and the next hearing is scheduled for December 27, 2024.

Advocate Junaid Mohammad Junaid expressed hope for a favorable outcome, emphasizing the need for a fair and rational reservation framework. “This petition is not directed against any specific community or class. It is about upholding the Constitution and ensuring the rule of law prevails,” he stated.

Imtiyaz Chesti, Chairman of the Jammu & Kashmir Civil Society, reiterated the organization’s commitment to advocating for justice and fairness. “The current policy needs urgent reforms to reflect constitutional principles. This is a step toward achieving greater equity and addressing genuine concerns,” Chesti remarked. [KNT]
