In a major reprieve to Er Rashid and his party, Awami Ittihad Party, the Delhi High Court on Tuesday granted custody parole to the jailed Member Parliament, to attend upcoming (Parliament) session.
After several delays in the backdrop of objections petitioned by National Investigation Agency (NIA), the Delhi High Court has finally granted custody parole to the jailed Member Parliament.
Rashid has been lodged in Tihar jail since 2019 after he was arrested by the National Investigation Agency (NIA) under the Unlawful Activities (Prevention) Act in the 2017 ‘militant funding case’.
The trail court had on September 10 granted interim bail to Sheikh Abdul Rashid, popular as Engineer Rashid, to enable him to campaign for the assembly elections in Jammu and Kashmir.
Rashid had earlier challenged a March 10 order of the trial court, refusing him custody parole or interim bail to attend Lok Sabha proceedings till April 4.
Informing about the fresh development, a party Spokesperson said, “the court, upholding the principles of justice and democratic representation, has granted permission for Rashid to attend Parliament while in custody.”
“This decision reaffirms the fundamental right of elected voices to be heard within the hallowed halls of democracy, ensuring that the people’s mandate is honored even in the face of adversity,” further reads the statement.
